Terms of Service

1. Acceptance of Terms

By accessing or using the GarageInsight platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including shop owners, technicians, service writers, and any other personnel using the platform.

2. Description of Service

GarageInsight provides a digital vehicle inspection platform for automotive repair shops, including:

• Digital vehicle inspection tools with photo and video capture
• AI-powered inspection summaries and customer communication
• Customer approval portal for service recommendations
• Recall and Technical Service Bulletin (TSB) alerts
• Analytics and reporting dashboards
• Voice-to-text note capture
• Integration with shop management systems

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring all users under your shop account comply with these Terms

4. Subscription and Payment

Access to the Service requires a paid subscription. By subscribing, you agree to:

• Pay all applicable fees based on your selected plan
• Provide accurate billing information
• Authorize recurring charges unless you cancel

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Refunds are provided at our discretion and in accordance with our refund policy.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload false, misleading, or fraudulent inspection data
• Share account credentials with unauthorized users
• Attempt to access other users' data without authorization
• Interfere with or disrupt the Service's operation
• Reverse engineer or attempt to extract source code
• Use the Service to transmit malware or harmful content
• Misrepresent vehicle conditions or service recommendations

6. Your Data and Content

You retain ownership of all data and content you upload to the Service, including inspection photos, videos, notes, and customer information ("Your Content"). By using the Service, you grant us a license to:

• Store, process, and display Your Content as needed to provide the Service
• Use anonymized and aggregated data to improve our products and services
• Generate AI-powered summaries and insights from Your Content

You are responsible for ensuring you have the right to upload and share all content, including customer information and vehicle data.

7. AI-Generated Content

The Service includes AI-powered features that generate inspection summaries and recommendations. You acknowledge that:

• AI-generated content is provided as a tool to assist, not replace, professional judgment
• You are responsible for reviewing and verifying all AI-generated content before sharing with customers
• We do not guarantee the accuracy of AI-generated summaries

8. Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by GarageInsight and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE ACCURACY OF VEHICLE RECALL OR TSB DATA OBTAINED FROM THIRD-PARTY SOURCES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GARAGEINSIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless GarageInsight and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may export your data before termination in accordance with our data export procedures.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Butler County, Pennsylvania.
